1. Acceptance of These Terms
These Terms of Use govern your access to and use of this website. By browsing the site, submitting an enquiry or otherwise interacting with us through it, you agree to be bound by these Terms. If you do not accept them, please do not use the website.
These Terms constitute an agreement in electronic form. In terms of the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), that agreement is as valid and enforceable as one recorded on paper.
We may amend these Terms from time to time. The version published on this page when you access the site is the version that applies to that visit.
2. Definitions

4. Permitted Use of the Website
You may use the website to learn about us and our talent, to view our content, and to submit genuine enquiries and booking requests. You may view, download and print reasonable extracts of the content for your own non-commercial reference, provided you keep all copyright and trade mark notices intact.
5. Prohibited Use
You may not:
- use the website for any unlawful purpose, or in a way that breaches these Terms
- copy, reproduce, republish, distribute, sell, licence, adapt or create derivative works from any content without our prior written permission
- use any content — including talent photographs, names, likenesses, showreels or biographies — for advertising, promotion or any commercial purpose without our prior written permission
- use the website to approach our talent directly in order to circumvent us as their representative
- submit false, misleading or fraudulent information through any form
- send unsolicited commercial communications, spam, chain messages or advertising through our forms or to addresses published on the site
- harvest, scrape or systematically extract data from the website, whether by automated means or otherwise, without our prior written permission
- introduce any virus, worm, trojan, logic bomb, keystroke logger or other malicious code
- attempt to gain unauthorised access to the website, its server, or any system or network connected to it
- probe, scan or test the vulnerability of the website, or breach or circumvent its security or authentication measures
- interfere with or disrupt the website or its infrastructure, including by any denial-of-service attack or by imposing an unreasonable load on it
- frame, mirror or deep-link to the website in a way that misrepresents our relationship with you or damages our reputation
- reverse engineer or decompile any part of the website, except to the extent the law expressly permits
Sections 86 to 88 of ECTA make unauthorised access to, interception of, or interference with data a criminal offence. We will report suspected offences to the South African Police Service and will co-operate with any investigation.
6. Intellectual Property
All content on the website, and the selection, arrangement and presentation of that content, is owned by us or licensed to us, and is protected by South African and international copyright, trade mark, design and other intellectual property laws.
The name “Goliath & Goliath”, our logo and our other marks are our trade marks. Nothing on the website grants you any licence or right to use them.
Photographs, showreels and biographical material relating to our talent are made available for the purpose of considering and arranging a booking. Any other use requires our written permission, and may also require the talent’s own consent.
If you believe content on the website infringes your rights, please contact us at connectwithus@goliathandgoliath.com with enough detail to identify the material and your claim, and we will investigate. This website operates under the notice-and-takedown provisions of Chapter XI of ECTA.
7. Enquiries and Bookings Are Not Contracts
This is important, so we state it plainly.
Nothing on this website is an offer capable of acceptance. The content, including any indication of a talent’s availability, is an invitation to do business and is not a binding offer.
Submitting a form on this website — including the contact form and the Book Talent form — is an enquiry only. It does not reserve any date, does not engage any talent, and does not create any contract or obligation between us.
A booking becomes binding only once we and you have concluded a separate written agreement, or you have accepted a written quotation from us and we have confirmed the booking in writing. That agreement or quotation governs fees, deposits, payment terms, technical requirements, travel and accommodation, cancellation and postponement, force majeure and everything else specific to the engagement. Where its terms differ from these Terms of Use, that agreement prevails.
We may decline any enquiry, and we are not obliged to give reasons.
8. Talent Representation
We act as agent and representative for the talent listed on this website. Each engagement is subject to the individual talent’s availability, approval and own requirements.
Our roster changes. A talent’s appearance on this website does not guarantee that they are available, that they remain represented by us, or that they will accept a particular engagement.
Except where we have expressly agreed otherwise in writing, we are not liable for a talent’s performance, conduct or non-appearance at an event. Your remedies in respect of a booked engagement are those set out in the booking agreement for that engagement.
9. Accuracy and Availability
We compile the website’s content with care, but we give no warranty that it is accurate, complete or current. Talent rosters, showreels, credits, services and descriptions change, and errors and omissions are excepted.
We try to keep the website available, but we do not warrant uninterrupted or error-free access. We may suspend, withdraw or restrict all or part of the website for maintenance, development or business reasons, without notice and without liability to you.
10. Third-Party Links and Embedded Content
The website links to and embeds material hosted by others, including social media platforms and video services. We provide those links and embeds for convenience only.
We do not control, endorse or assume responsibility for third-party websites or their content, products, services or privacy practices. Following an external link is at your own risk, and the terms and privacy policy of that third party will apply to your use of it.
11. Disclaimer and Limitation of Liability
The website and its content are provided “as is” and “as available”. To the fullest extent the law permits, we exclude all warranties, representations and conditions that are not expressly set out in these Terms, whether implied by statute, common law or otherwise.
To the fullest extent the law permits, neither we, nor our directors, employees, agents or the talent we represent, will be liable for any indirect, incidental, special, punitive or consequential loss, or for any loss of profit, revenue, business, anticipated saving, goodwill, data or opportunity, arising out of or in connection with your use of the website — whether that claim is founded in contract, delict, statute or otherwise, and whether or not we were advised of the possibility of such loss.
Where our liability cannot lawfully be excluded, it is limited to the greater of [AMOUNT — e.g. R5 000] and the amount you have actually paid us under a booking agreement in the 12 months preceding the claim.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, for fraud, or any right you have under the Consumer Protection Act 68 of 2008 that cannot be contracted out of.
You use the website at your own risk, and you are responsible for protecting your own device and data against viruses and other harmful code.
12. Indemnity
You indemnify us and hold us harmless against any claim, demand, loss, damage, cost or expense, including reasonable legal fees, arising from your breach of these Terms, your unlawful or negligent use of the website, or any content or information you submit through it.
13. Privacy and Personal Information
Our Privacy Policy explains what personal information we collect through this website, why we process it, who we share it with, how long we keep it and what rights you have under POPIA. It forms part of these Terms. Please read it before submitting any information to us.
14. Electronic Communications
You consent to us communicating with you electronically. A data message we send is deemed received when it becomes capable of being retrieved and processed by you. A data message you send is deemed received only when we actually receive it — our systems are not deemed to accept anything automatically.
Any notice we must give you under these Terms may be given by email to the address you gave us, or by publication on this website.
15. Amendments
We may change these Terms at any time by publishing the amended version on this page and updating the “last updated” date. The change takes effect when published. Please review these Terms each time you use the website. Continuing to use the website after a change means you accept the amended Terms.
16. Governing Law, Jurisdiction and General
These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa. You consent to the jurisdiction of the South African courts in respect of any dispute arising from these Terms or your use of the website, and you agree that the Magistrate’s Court has jurisdiction notwithstanding that the amount in dispute may exceed its ordinary jurisdiction.
- Severability. If any provision of these Terms is found to be invalid, unenforceable or unlawful, it is severed and the remaining provisions continue in force.
- No waiver. Our failure or delay in enforcing any provision is not a waiver of it, and does not prevent us from enforcing it later.
- Whole agreement. These Terms, together with our Privacy Policy, constitute the whole agreement between us in relation to your use of the website, and supersede any earlier understanding.
- Cession. You may not cede or assign your rights or delegate your obligations under these Terms without our written consent. We may cede, assign or delegate ours in connection with a reorganisation or sale of our business.
- Dispute resolution. Before starting legal proceedings, please contact us so that we can try to resolve the matter directly.
